Overview
President Trump's executive order denies U.S. birthright citizenship to children born in the United States if their parents are in the country unlawfully or on temporary visas. The question before the Court is whether the order is constitutional under the Citizenship Clause of the 14th Amendment, which courts have long interpreted to grant citizenship to virtually all children born on U.S. soil. It is one of the most consequential immigration cases in decades, with the potential to upend a principle settled since Wong Kim Ark in 1898.
